Michael Calvey released from house arrest
The Supreme Court of Russia released from house arrest the founder of the investment fund Baring Vostok Michael Calvey, his partner Philippe Delpal and other defendants in the case of embezzlement of 2.5 billion rubles. The measure of restraint was changed to prohibit certain actions. Earlier, on November 12, the Arbitration Court of the Amur Region terminated the case on the claim of Vostochny Bank against Evison Holdings Limited, controlled by Baring Vostok, and Mr. Calvey. The parties announced the settlement of claims within the framework of the settlement agreement.
“To change the measure of restraint for the persons involved in the case from house arrest to the prohibition of certain actions,” the judge decided (quoted by TASS). At the same time, the court forbade the defendants in the case to be in the premises of the Vostochny Bank and the First Collection Bureau, as well as to leave the house at night, communicate with each other and use the phone outside of emergency situations.
“We are glad that the Supreme Court made the long-awaited and the only correct decision – to release our innocent colleagues from arrest. Their criminal prosecution, which lasts a year and 9 months, should be terminated, because there is neither corpus delicti, nor victims in the case: Bank Vostochny, having received a second refund, withdrew the civil claim. In addition, the case file does not contain any evidence of the guilt of the defendants in the case. We are confident in the innocence of our colleagues and will continue to seek justice, ”a representative of Baring Vostok told Kommersant.
On October 28, it is known that the First Collection Bureau, which is associated with Baring Vostok, will pay Vostochny Bank 2.5 billion rubles. Also at the end of October, the Prosecutor General’s Office approved the indictment in the case of the alleged embezzlement of funds from Vostochny Bank. The corporate conflict between the shareholders of Vostochny lasted since 2018.
